Alcohol-related offenses (DUI, DWI, APC)

Within the State of Oklahoma, it is unlawful to drive with a blood alcohol content greater than 0.05%. If you are found driving with a blood alcohol content greater than 0.05% but less than 0.07% you may be charged with the crime of driving while impaired (“DWI”). DWI is a misdemeanor. The penalty for a DWI can include loss of driver’s license, up to six (6) months incarceration, fines and court costs.

If your blood alcohol content is 0.08% or higher, you will likely be charged with driving under the influence (“DUI”). If your blood alcohol content is 0.15% or higher, you will likely be charged with Aggravated DUI.

DUI is generally charged as a misdemeanor. The penalty associated with misdemeanor DUI can include loss of driver’s license, completion of the victim’s impact panel (“VIP”), alcohol/drug assessment (including counseling), and incarceration up to one year.

There may be circumstances in which a DUI is charged as a felony, including, but not limited to your previous criminal history or if there was an accident involved which resulted in the loss of life. The penalties for felony are much more severe, including increased periods of incarceration.

Both DUI and DWI require the operation of a motor vehicle. The crime of Actual Physical Control (“APC”), however, does not require the vehicle to be driven. These cases generally occur when a law enforcement officer finds an intoxicated individual asleep in a vehicle (on the side of the road or in a parking lot). The penalty associated with the crime of APC is the same as DUI.
